SERVICE TERMS

TIMBER BROS, LLC

Effective Date: October 17, 2026

At Timber Bros, we take pride in providing safe, reliable, and professional tree care and land management services. These Service Terms & Conditions explain what customers can expect when working with us and outline the responsibilities of both Timber Bros and the customer.

These terms apply to services provided by Timber Bros, LLC, including tree removal, tree trimming and pruning, stump grinding, lot clearing, logging, excavating, storm cleanup, and related services.

By approving an estimate or signing a service agreement that incorporates these terms, you agree to the following conditions, subject to applicable law.

1. Estimates & Pricing

All estimates provided by Timber Bros are valid for 30 calendar days from the date issued, unless otherwise stated.

Estimates are based on the scope of work, visible property conditions, accessibility, equipment requirements, and anticipated labor at the time of assessment.

The final price will reflect the services outlined in the approved estimate. Additional work, unexpected site conditions, or customer-requested changes may require a revised estimate or additional charges.

Any additional work and associated costs must be approved by the customer before proceeding.

2. Scheduling & Weather

We make every effort to complete services according to the agreed schedule. However, outdoor work is subject to weather, ground conditions, equipment availability, and other circumstances beyond our reasonable control.

Timber Bros reserves the right to reschedule or suspend work when conditions may compromise safety or the quality of our services.

We will communicate significant scheduling changes as promptly as reasonably possible.

3. Property Access & Preparation

Customers are responsible for providing safe and reasonable access to the designated work areas.

Before our crew arrives, please:

  • Remove vehicles, furniture, decorations, toys, and other movable items from work areas.

  • Keep children, pets, and unauthorized individuals away from active work zones.

  • Notify us of underground irrigation, septic systems, invisible fences, private utilities, and other known obstructions.

  • Identify property boundaries and obtain permission for any work involving neighboring property.

  • Ensure gates, driveways, and access routes are available as agreed.

Customers must have the legal authority to approve the work being performed.

If access is restricted or site conditions differ significantly from those described during the estimate, additional arrangements or pricing adjustments may be necessary and will require customer approval.

4. Lawn & Property Conditions

Tree care and land management services often require heavy equipment, specialized machinery, and the movement of substantial amounts of wood and debris.

Although Timber Bros takes reasonable precautions to protect your property, certain impacts may be unavoidable, including:

  • Tire tracks, ruts, or soil compaction.

  • Minor disturbance to grass, mulch, or landscaping.

  • Sawdust, wood chips, and organic debris.

  • Ground disturbance near tree removals and stump grinding locations.

Lawn restoration, grading, reseeding, or landscaping repairs are not included unless specifically identified in the approved estimate.

Timber Bros remains responsible for damage caused by its negligence or other legally actionable conduct. Customers do not waive any rights provided by applicable law.

5. Tree Removal & Pruning

Tree removal and pruning will be performed according to the services described in the approved estimate.

Unless specifically included:

  • Stump grinding is not part of standard tree removal.

  • Underground root removal is excluded.

  • Log removal, hauling, and disposal are determined by the estimate.

  • Replacement trees or landscaping are not provided.

Tree pruning is performed using professional judgment and reasonable industry practices.

Because tree health depends on weather, disease, environmental conditions, and other factors, Timber Bros cannot guarantee the continued health or structural stability of a tree following service.

6. Stump Grinding & Underground Utilities

Stump grinding includes only the depth, area, and cleanup identified in the estimate.

Root removal, hauling of grindings, topsoil, reseeding, and landscaping restoration are excluded unless otherwise specified.

For work requiring underground utility notification, Timber Bros will comply with applicable Michigan MISS DIG 811 requirements.

Customers must disclose known private utilities, irrigation systems, septic components, invisible fences, and other underground features that may not be identified through public utility locating.

If private utility locating is needed, the parties will agree on responsibility and any associated cost before work begins.

Timber Bros may suspend work if unidentified utilities or hazardous underground conditions are discovered.

7. Permits & Property Authorization

Customers are responsible for providing accurate property ownership and boundary information.

Any required permits, authorizations, or permissions must be obtained before work begins. Responsibility for obtaining these approvals will be identified in the estimate or service agreement.

Timber Bros may decline or postpone work if necessary permissions have not been obtained.

8. Cleanup & Debris Removal

Timber Bros strives to leave work areas clean and orderly.

Cleanup and debris removal will be performed according to the approved estimate.

Unless specifically included, the following may require additional services:

  • Removal of preexisting debris.

  • Hauling away logs, firewood, or wood chips.

  • Removal of stump grindings.

  • Lawn or landscape restoration.

  • Additional grading or site preparation.

Any wood or materials designated to remain on the property will be placed in an agreed location when reasonably practicable.

9. Payment Terms

Final payment is due upon completion of the agreed services and presentation of the final invoice, unless otherwise specified in writing.

Any required deposit will be identified in the estimate and applied toward the total project cost.

Approved additional services will be included in the final invoice.

Customers should contact Timber Bros promptly with questions or concerns regarding an invoice.

Any late charges or collection fees must be separately disclosed, agreed upon, and permitted by applicable law.

For insurance-related work, the customer remains responsible for payment under the service agreement unless otherwise agreed in writing. Timber Bros does not guarantee reimbursement from insurance providers.

10. Cancellations & Rescheduling

We understand that plans can change.

Timber Bros requests at least 48 hours' notice whenever possible for appointment cancellations or rescheduling.

This notice period is a courtesy request, not an automatic cancellation fee.

If a project is canceled after Timber Bros has incurred reasonable, documented, nonrecoverable expenses, reimbursement may be requested to the extent permitted by the agreement and applicable law.

No cancellation charges will apply when prohibited by law or when a customer properly exercises an applicable statutory cancellation right.

Timber Bros may reschedule work due to weather, safety concerns, equipment availability, or unforeseen circumstances.

Consumer Cancellation Rights

Certain customer agreements may qualify for cancellation rights under Michigan or federal law, including qualifying in-home sales or home-improvement financing transactions.

Where applicable, Timber Bros will provide the required cancellation notices and forms.

Nothing in these Service Terms limits or eliminates a customer's statutory cancellation rights.

11. Emergency & Storm Services

Emergency tree services may involve hazardous trees, unstable structures, fallen power lines, or other dangerous conditions.

Timber Bros will evaluate conditions and determine appropriate work procedures before beginning services.

Emergency projects may require specialized equipment, additional personnel, or revised work plans.

Any additional charges will be communicated and approved before proceeding, except where otherwise permitted by law.

Timber Bros does not guarantee immediate emergency availability.

12. Safety

Safety is a priority for Timber Bros.

Customers and unauthorized individuals must remain outside designated work areas during operations.

Timber Bros reserves the right to pause or discontinue work if conditions present an unreasonable safety risk.

Our crews determine appropriate equipment, operational methods, and safety procedures consistent with applicable requirements and professional practices.

13. Insurance & Liability

Timber Bros will maintain insurance as required by applicable law and any specific written contractual commitment.

We exercise reasonable care to protect customers, surrounding structures, and property while performing services.

Customers should promptly report suspected damage related to our work and provide a reasonable opportunity for inspection.

Nothing in these terms releases Timber Bros from liability for negligence, gross negligence, willful misconduct, or other obligations that cannot legally be waived.

14. Changes to Services

Requests to add, remove, or modify services after an estimate has been approved may affect pricing and scheduling.

Any material changes must be approved by both Timber Bros and the customer before additional work begins.

Changes may be documented through written or electronically approved change orders.

15. Photography & Video

Timber Bros may photograph or record project areas for internal documentation, estimates, safety, quality control, and insurance purposes, subject to applicable law.

Separate customer consent is required before identifiable project photographs or videos are used for public marketing, advertising, social media, or promotional materials.

Marketing consent is optional and is not a condition of receiving services.

16. Customer Satisfaction & Workmanship

We take pride in our workmanship and strive to provide professional, dependable service.

If you have concerns regarding completed work, please contact us so we can review the issue and determine appropriate next steps.

Any express workmanship warranty will be identified separately in writing.

These terms do not limit customer protections or remedies available under applicable law.

17. Disputes & Governing Law

If a disagreement arises, Timber Bros and the customer agree to make a good-faith effort to resolve the issue through direct communication.

If a resolution cannot be reached, either party may pursue available legal remedies.

These Service Terms are governed by the laws of the State of Michigan, subject to applicable federal law and mandatory consumer protections.

18. Agreement & Acceptance

These Service Terms, together with the approved estimate, authorized change orders, and legally required notices, form the agreement governing the specified services.

If any provision is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

By signing or electronically accepting an estimate or service agreement that incorporates these terms, the customer acknowledges receiving and reviewing them and authorizes the agreed work, subject to applicable cancellation rights.
